Welcome to XHIBO. These Terms of Service ("Terms") govern your access to and use of all platforms owned or operated by XHIBO, including but not limited to our website, mobile applications, official social media pages, and any other digital services (collectively referred to as the "Service").

For the purposes of this agreement, the term XHIBO shall legally encompass and refer to all authorized brand variations, including but not limited to Xhibo, xhibo.com, and XB. By accessing any part of the Service, you agree to be bound by these Terms.

1. Use of Our Services

You must be at least 18 years old to use our services. You agree to use our site for lawful purposes only and not to use it in a way that infringes the rights of, restricts, or inhibits anyone else's use and enjoyment of the site.

2. Nature of Service: Curation

XHIBO provides a curated marketplace. We act as an intermediary, selecting third-party products based on supplier data and listing clarity. Our published selection standards include seller track record (positive feedback history and order volume), listing accuracy, and sizing clarity.

  • No Manufacturing: XHIBO does not manufacture the goods offered.
  • Quality Acknowledgment: While XHIBO curates its product selection, the user acknowledges that "quality" and "aesthetic" are subjective standards. The final product quality, materials, and sizing are the sole legal responsibility of the original manufacturer.

3. Account Security & Data Integrity

To access certain features of the Service, you may be required to create an account.

  • User Responsibility: You are solely responsible for maintaining the confidentiality of your credentials across all platforms (Web or Social).
  • Security Standards: In alignment with industry-standard cybersecurity practices, XHIBO requires users to utilize unique, complex passwords. XHIBO implements technical controls to protect user data; however, you must notify XHIBO immediately of any suspected unauthorized access.

4. Orders, Payment, and Fulfillment

All orders are subject to product availability and confirmation of the order price.

  • Pricing Accuracy: XHIBO reserves the right to correct any pricing or typographical errors at any time without liability.
  • Shipping Estimates: Delivery windows are estimates provided by third-party logistics partners and are not guaranteed. XHIBO is not liable for delays caused by customs, global logistics, or force majeure events.
  • Import Duties: US orders may be charged import duties on delivery. If you are, email us the bill at support@xhibo.com and we'll reimburse you.
  • Fraud Prevention: XHIBO reserves the right to cancel any order that triggers our internal security and fraud risk parameters.

5. Intellectual Property

The XHIBO name, logo, website design, and original written content on this site are the property of XHIBO. Product images displayed on this site are provided by third-party suppliers. XHIBO does not claim ownership of supplier-provided product images. If you believe any image on this site infringes your copyright, please see Section 5A below.

5A. Copyright Takedown Requests

XHIBO respects the intellectual property rights of others. If you are a copyright holder and believe that content on this site infringes your rights, you may request its removal by contacting us at support@xhibo.com with the following information:

  • Identification of the copyrighted work you claim has been infringed
  • The URL of the page on xhibo.com where the allegedly infringing content appears
  • Your name, company (if applicable), and contact information
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement that the information you provide is accurate

Upon receiving a valid request, we will promptly review and remove the allegedly infringing content.

6. Disclaimer of Warranties; Limitation of Liability

The Service and all products are provided "as is" and "as available" for your use.

  • XHIBO disclaims all warranties of any kind, whether express or implied.
  • In no event shall XHIBO, its directors, or employees be liable for any injury, loss, or direct/indirect damages arising from your use of any platform or product procured through our Service.

7. Indemnification

You agree to indemnify and hold XHIBO harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law.

8. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the jurisdiction in which XHIBO is registered. Any dispute arising from these terms shall be resolved through binding arbitration in the registered jurisdiction, and you waive any right to participate in a class-action lawsuit.

XHIBO is committed to digital inclusion. If you encounter any accessibility barriers on our platforms, please contact us at support@xhibo.com, and we will work to provide the information or service through alternative means.

10. Changes to Terms

XHIBO reserves the right to modify these Terms at any time. We will provide 30 days' notice prior to any new terms taking effect. Your continued use of any XHIBO platform after such changes signifies your acceptance.
