Welcome to XHIBO. These Terms of Service ("Terms") govern your access to and use of all platforms owned or operated by XHIBO, including but not limited to our website, mobile applications, official social media pages, and any other digital services (collectively referred to as the "Service").

For the purposes of this agreement, the term XHIBO shall legally encompass and refer to all authorized brand variations, including but not limited to Xhibo, xhibo.com, and XB. By accessing any part of the Service, you agree to be bound by these Terms.

1. Use of Our Services

You must be at least 18 years old to use our services. You agree to use our site for lawful purposes only and not to use it in a way that infringes the rights of, restricts, or inhibits anyone else's use and enjoyment of the site.

2. Nature of Service: Vetting & Curation

XHIBO provides a curated marketplace and vetting service. We act as a professional intermediary, selecting third-party products based on historical performance data and quality benchmarks.

  • No Manufacturing: XHIBO does not manufacture the goods offered.
  • Quality Acknowledgment: While XHIBO uses a rigorous vetting process to select partners, the user acknowledges that "quality" and "aesthetic" are subjective standards. The final product quality, materials, and sizing are the sole legal responsibility of the original manufacturer.

3. Account Security & Data Integrity

To access certain features of the Service, you may be required to create an account.

  • User Responsibility: You are solely responsible for maintaining the confidentiality of your credentials across all platforms (Web, App, or Social).
  • Security Standards: In alignment with industry-standard cybersecurity practices, XHIBO requires users to utilize unique, complex passwords. XHIBO implements technical controls to protect user data; however, you must notify XHIBO immediately of any suspected unauthorized access.

4. Orders, Payment, and Fulfillment

All orders are subject to product availability and confirmation of the order price.

  • Pricing Accuracy: XHIBO reserves the right to correct any pricing or typographical errors at any time without liability.
  • Shipping Estimates: Delivery windows are estimates provided by third-party logistics partners and are not guaranteed. XHIBO is not liable for delays caused by customs, global logistics, or force majeure events.
  • Import Duties: For products sourced via the XHIBO vetting process, the customer is considered the "Importer of Record." You are responsible for all Customs Duties, VAT, or Import Taxes levied by your local jurisdiction.
  • Fraud Prevention: XHIBO reserves the right to cancel any order that triggers our internal security and fraud risk parameters.

5. Intellectual Property

All content, logos, and the proprietary "Vetting Methodology" used on this site are the exclusive property of XHIBO. The proprietary algorithms, data-analysis methodologies, and vetting systems used to curate the Service remain the sole trade secrets of XHIBO. You may not use XHIBO trademarks or trade dress in connection with any product or service without prior written consent.

6. Disclaimer of Warranties; Limitation of Liability

The Service and all products are provided "as is" and "as available" for your use.

  • XHIBO disclaims all warranties of any kind, whether express or implied.
  • In no event shall XHIBO, its directors, or employees be liable for any injury, loss, or direct/indirect damages arising from your use of any platform or product procured through our Service.

You agree to indemnify and hold XHIBO harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law.

These Terms shall be governed by the laws of the jurisdiction in which XHIBO is registered. Any dispute arising from these terms shall be resolved through binding arbitration in the registered jurisdiction, and you waive any right to participate in a class-action lawsuit.

10. Changes to Terms

XHIBO reserves the right to modify these Terms at any time. We will provide 30 days' notice prior to any new terms taking effect. Your continued use of any XHIBO platform after such changes signifies your acceptance.
